Terms & Conditions
We have some standard rules that are designed to ensure that we comply with regulations relating to matters such as fire, health and safety, and to enhance the comfort and wellbeing of our guests. If you would like to check our conditions of stay please contact us. We reserve the right to terminate Your Booking immediately without being liable for any refund or compensation where You engage in unacceptable behaviour that causes a disturbance or nuisance to other guests or our neighbours.
Bookings
Bookings are made and a contract between You (the Guest) and Us (11554140 Canada Inc. o/a Blue Moon Retreat) comes into effect when We accept a reservation from You. We will accept a reservation when We have confirmed Your reservation and received a deposit payment of the total price quoted from You or in the event that we require a non-refundable security deposit, when we have received full payment of the total value of the non-refundable deposit. You, as the Party Leader, must be able to enter into a legally binding contract and be over 18yrs to make a Booking. The party leader must be authorised to make the booking on the basis of these Booking Conditions by all other members of the party. By making the booking, the party leader confirms that he/she is so authorised and that all other party members agree that the booking is subject to these Booking Conditions. The party leader is responsible for making all payments due to us.
Payments
Bookings must be paid for using an acceptable and valid credit card. When you book you should pay the deposit or full amount then due credit card. Blue Moon Retreat will bill your credit card the balance no less than 30 days before the start of your arrangements. However, if you book less than 30 days before the start of your arrangements, full payment of the total cost must be paid at the time of booking. If your payment is not honoured for any reason whatsoever, we are entitled to keep your deposit.
When a Booking is confirmed, a reservation number is given. This number must be retained for access to the Booking details if cancellation or amendment is necessary.
Prices
All published rates are subject to HST, which is not reflected in the published rate unless stated otherwise.
Rates are for the length of the stay You selected (eg 3,4,7 nights). If You have selected supplements they will be added to the total price of the Booking. Rates do not include other costs you may choose to incur during Your stay (unless otherwise stated).
Rates quoted are correct only for the specific number of guests, nights and dates shown. Should You change the number of guests, dates or nights, then the rates are subject to change.
Arrival and Departure
(i) Check In
Check-in times are specified on your booking confirmation and are usually from 4pm onwards. Please contact Us to inform approximately what time you will be arriving to provide details of how to collect the keys.
(ii) Check Out
The Check-out time is also specified on your booking confirmation and is usually 11:00am.
Smoking
The property is strictly NON-smoking inside the cottages.
Fireworks
Due to the very serious risk of forest fires, fireworks are strictly prohibited on our property at all times. Violating this important policy will result in eviction without refund.
Noise Bylaw
The local municipality has an anti-noise bylaw which prohibits unnecessary outside noise after 11:00PM – this bylaw is enforced by the Ontario Provincial Police. We ask that you obey the law and be considerate (especially in regards to noise) of other guests and our neighbours at all hours of the day and night. Unacceptable behaviour can result in immediate eviction without refund.
Wildlife
Feeding wildlife is prohibited by the Municipality of Hastings Highlands. We ask that you appreciate the wildlife from a distance only, as nature intended, including the birds, chipmunks, squirrels, etc. Feeding and/or distributing food to these small animals also attracts vermin and potentially disease. These animals, and the vermin that are also attracted, are also destructive. When the animals become more habituated to humans, they begin entering the cottages. We then have to take unpleasant steps to mitigate the problem. Distributing food for the wildlife has also been known to attract dangerous animals like bears. Pets
We welcome dogs & cats (other pets require prior approval) to our Pet Friendly cottages. There is no extra charge for pets. Prior approval is required for more than 2 pets/cottage and/or if your pet is other than a dog or a cat. All pets are to be flea & tick treated, fully vaccinated, & well behaved (means under control at all times). Pets are to be on a leash when outside & not to be left alone inside or outside for prolonged periods. While inside, pets are not allowed on furniture or furnishings at any time. Droppings (& bones for dogs) are to be picked up and disposed of in rubbish bin.
You are responsible for (and will be charged for) any extra cleaning costs due to messes and/or excess shedded hair. Please clean up after your pet to avoid these extra charges. Any disturbances, such as barking, must be curtailed to ensure that other guests are not disturbed or inconvenienced. If any pet deemed a disturbance to other guests, or their pets, cannot be controlled, you will be asked to keep your pet indoors, other than brief, leashed, bathroom breaks outdoors. You are responsible for all property damages and/or personal injuries resulting from your pet.
The resort is in a wilderness area and there are local wild animals that might harm your pet. You are responsible for taking the necessary precautions to protect your pet and You further agree to indemnify and hold harmless Blue Moon Retreat; its owners and operators, from all liability and damage suffered as a result of your pet. You indicate your agreement by bringing your pet to the resort.
Open Air Burning (i.e. firepits/campfires)
Campfires between 7:00 a.m. and 7:00 p.m., during the period from April 1 to October 31, are not permitted. Fires must not be left unattended for more than a few minutes at a time. Guests must have a pitcher or pale of water nearby at all times during the burn and fires must be fully extinguished prior to retiring from the firepit area.
Booking Terms and Conditions
‘Blue Moon Retreat’ Terms of Business are as follows: These Booking Terms apply to the business named above (under the Booking with section of the Booking Confirmation and the Provider Information in the confirmation email) our officers and the person or legal entity making the Booking or to whom We supply services in respect of the Booking (You/Your/Party Leader). These Booking Terms are governed by Ontario law and apply to all Bookings except where We agree in writing other terms. By making a Booking You are deemed to accept these Booking Terms.
Security Deposit
We may require that You pay a security deposit prior to commencement of your stay. The security deposit will be refunded by Us at the end of your stay (less any costs for breakages, damage, etc., if applicable). The refund will occur within 14 days of your departure. You and all members of your party agree to keep the cottage clean and tidy, to leave the cottage in a similar condition as you found it upon your arrival, and to behave lawfully at all times whilst at the cottage. You and all members of your party further agree not to use the cottage for any unlawful or commercial purpose, including without limitation assigning or subletting it or otherwise allowing anyone to occupy it who has not previously been accepted by Us. You are responsible to Us for the actual costs of any breakage or damage in or to the property – along with any additional costs that may result – which are caused by you and/or any members of your party, We can require payment from you to cover any such costs, and broken items will require a like for like replacement. Overcrowding is not allowed. Exceeding cottage maximum will result in the immediate eviction with no refund. There are NO camping, tents or camping trailers allowed on the property.
We are entitled at our sole and absolute discretion to refuse to hand over to you, the cottage if We reasonably believe you or any member of your party is behaving unlawfully, or that any damage is likely to be caused, has been caused or is being caused by the behaviour of you or any members or your party. These circumstances will be treated as a cancellation by You. You also must not allow more people than stated to occupy the property, neither can you significantly change the composition of your party during your occupation of the property. If you do any of these things, We can refuse to hand over the property to you, or can repossess it. If this does happen, this will be treated as a cancellation by You. In these situations no refund of any monies you have paid in respect of your booking will be made and We will not have any liability to You as a result of this situation arising (including for example any costs or expenses you incur due to not being able to occupy the property, such as the cost of securing an alternative property/ accommodation or the payment of any compensation to you). We are not obliged to find any alternative accommodation for you. You must allow Us and any representative Blue Moon Retreat (including workmen) access to the property at any reasonable time during your occupation of the property (except in cases of emergency or where a problem needs remedying quickly and you cannot be contacted in time – in these situations We are entitled to enter the cottage at any time without giving you prior notice).
Availability
In the rare case that due to unforeseen circumstances we cannot deliver Your requested accommodation, You will be offered alternate accommodation.
Special Requests
If you have any special requests you must advise us at the time of booking. Although we will endeavour meet any reasonable requests, no guarantees can be given that any request will be met. Confirmation that a special request has been noted, or the inclusion of the special request on your written confirmation or any other documentation, is not confirmation that the request will be met. Failure to meet any special request will not be a breach of your contract. Conditional bookings cannot be accepted ie: any booking which is specified to be conditional on the fulfilment of a particular request.
Liability
The use of all facilities and services of the resort and cottages and those of our partners is at the renter’s risk. By paying, the renter accepts this risk on behalf of themselves and all other members of their party. Our total liability to You is limited to the price of the Booking and to the fullest extent permitted by law all warranties are excluded and in no circumstances will We be responsible for any indirect or special damages. We will not be liable for failure to perform to the extent that the failure is caused by any factor beyond Our reasonable control. You are responsible for any damage or loss caused to Us or our Our property by Your act, omission, default or neglect and You agree to indemnify Us and to pay Us on demand the amount reasonably required to make good or remedy any such damage or loss.
Data Protection
We may process the information You provide to Us for the purposes of making a Booking and contacting you periodically through email. By making a booking inquiry or booking, You consent to this processing of information.
Amendments and Cancellations
To amend or Cancel your Booking, call or email Blue Moon Retreat directly, as soon as possible, using the details contained within the booking confirmation.
(i) Amendments
If you wish to change any detail of your confirmed booking we will do our best to make the changes. However, we cannot guarantee that we will be able to meet any such request.
(ii) Guest Cancellations
Because of our very small size, cancellations have a significant impact on us. A 50% deposit is required to reserve the cottage, with the remaining 50% balance payment due 30 days prior to your arrival.
If you need to cancel your booking for any reason, and:
- the cottage is rebooked by another guest for your dates, you will receive a full refund of all monies paid.
- the cottage is NOT rebooked for your dates by another guest, then all monies paid (less a 15% + HST rebooking fee) can be used as a credit towards a future stay within two years of the cancellation date.
(iii) Government/Authority Forced Cancellations
If we are accepting reservations, and you wish to make a future booking while government restrictions are currently in place, you can rest assured that reservation payments to Blue Moon Retreat are secured for you by this cancellation policy. During periods of uncertain times (e.g. COVID-19 state of emergency restrictions), deposits (and balance payments) will be held in “trust”. Should your booking require cancellation due to government orders, you will receive a full refund of all monies paid. No fees or other caveats.
(iv) Blue Moon Retreat Cancellations
We do not expect to have to make any changes to your booking, but sometimes problems occur and bookings have to be changed or cancelled or errors in brochures or other details corrected.
(v) Force Majeure
Except where otherwise expressly stated in these Booking Conditions, we regret that we cannot accept liability or pay any compensation where the performance or prompt performance of the obligations under your Booking Terms and Conditions by Us is prevented or affected by or you otherwise suffer any damage or loss as a result of Force Majeure. In these Booking Conditions a Force Majeure means an event beyond the reasonable control of the Owner and/or us which we or the Owner in question could not, even with all due care, foresee or avoid including, but not limited to strike, lock-out, labour dispute, act of God, acts of terrorism, war, riot, civil commotion, malicious damage, compliance with a law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, insolvency or bankruptcy of an Owner, fire, flood, snow and storm, difficulty or increased cost in obtaining workers, goods or transport and other circumstances affecting the supply of goods or services.
